Simon King and Peter Humpherson are solicitors who regularly act on behalf of landlords who encounter problem tenants and want to get their own property back. At the next meeting of the National Landlords Association in Tamworth on Thursday 23rd October, they will be addressing this topic. They will explain how to recover possession of rented property using Section 8 of the Housing Act 1988, including advice on ensuring that notices served upon tenants are valid.
They will examine some of the 17 grounds that can be relied upon when applying to Court under Section 8 and highlight those grounds where an order must be made in the Landlord’s favour and those where the Judge has a discretion.
They will also consider whether it may be a good idea to serve notices under both Section 21 and Section 8.
Non-payment of Rent is often the thing that persuades a landlord that it’s time to take the property back, so they will explore the prospect of recovering that debt.
Other speaker at this event will be Dave Whortley, Benefits Manager, Rugby Borough Council, providing an update on universal credit and Rugby Borough Councils pilot project.
